6 in 10 companies still lack a valid asbestos inventory: Avoid penalties and make your appointment now.

A recent study by the Labour Inspectorate shows that the majority of our companies and schools do not yet have an asbestos inventory. However, it is compulsory to have such an inventory drawn up. This way, you protect your employees and ensure that any renovation work can be done safely. Asbestos is still the cause of many dangerous cancers. A proper inventory is therefore of prime importance.

For whom is an asbestos inventory mandatory?

Asbestos inventory CODEX has been mandatory under the regulations on employee welfare in the workplace since 1995. Real Estate Experts also has the necessary expertise to offer this at short notice.

Every employer is required to draw up an asbestos inventory for any building or installation where workers may be exposed to asbestos.

So this applies, for example, to :

  • Companies (office, factory, workshop, warehouse, etc.)
  • Schools, care facilities, public buildings
  • Technical installations, pipes, etc.

Example 1 : A building/office where maintenance staff (cleaning service) will be on site needs an asbestos inventory codex welfare.

Example 2 : An flat with a concierge (concierge guards the building , is employee)

Example 3 : An flat with a lift (lift maintenance staff)

Example 4 : works are planned on the heating installation , if asbestos has been identified, the planned works may not be carried out by a standard heating installer but an approved remediation contractor must be appointed.

What should I take into account?

If you are having an asbestos inventory drawn up for your organisation, there are a number of things it is best to bear in mind. For example, the inventory should be drawn up/available before the start of any works on the building.

The inventory should also be updated regularly, especially in case of works or changes to the building / annual update.

The inventory should be available for:

  • Employees
  • Internal/external prevention and protection service
  • FPS employment on inspection
  • Works executives (contractors, technicians)

If asbestos is identified in the inventory, a management programme and risk analysis must also be drawn up. This is included in the asbestos inventory codex welfare.

This programme includes:

  • Visual inspections (at least annually).
  • Taking appropriate preventive measures.
  • Maintain and update the inventory and programme when the state of asbestos changes.

In addition to the asbestos certificate for private dwellings it is therefore also important to take into account the obligations that apply to buildings in which people are employed.

What penalties do you risk if you do not have an asbestos inventory drawn up?

If you have not had an asbestos inventory drawn up when required by law, you are at risk of:

  1. Sanctions through the labour inspectorate (Supervision of Workplace Welfare - TWW):
  • Compliance order: You may first receive a written warning or order to take the necessary steps within a certain period of time.
  • Official report: If the written warning is not acted upon, an official report may be drawn up.
  1. Criminal sanctions (Social Penal Code):
  • Failure to comply falls under level three or four of the Social Penal Code.
  • Possible penalties:
    • Fines (administrative or criminal): ranging from several hundred to tens of thousands of euros.
    • Prison sentences for serious offences (for level 4 offences).
    • Stoppage of work or construction halt.

If no asbestos inventory is available, it means that any renovation or demolition work cannot be carried out safely. The risk of potential exposure is then too high and can have dramatic consequences for the health of building occupants.

This can lead to:

  • Acute work stoppage due to inspection intervention
  • Liability in case of asbestos exposure or health problems
